Speaker Release and Authorization Agreement
The undersigned (“Speaker”) authorizes The Digital Marketing with AI Summit, GetCertificate.Online, and their affiliates, successors, and assigns (collectively, the “Organization/s”) to make audio, video, photographic, and text recordings by any means and in any media (the “Recordings”) of the Speaker’s presentation, workshop, training, or program described in the submission form (the “Event”), and further authorizes the Organization/s to use the Speaker’s name, company or organization name, title, photograph, likeness, and biographical information (the “Speaker Information”) in connection with the reproduction, distribution, marketing, and promotion of the Event and the Recordings. The Speaker understands and agrees that the Organization/s shall be the sole and exclusive owner of the Recordings and all rights therein, and grants the Organization/s a perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, worldwide license to use, copy, edit, exhibit, publish, perform, distribute, play, sell, show, display, adapt, and otherwise exploit the Recordings and any derivative works, as well as any Event-related handouts or materials provided by the Speaker, in any media now known or later developed, including but not limited to websites, social media, press releases, publications, digital promotions, and print materials, for both commercial and non-commercial purposes, with the right to sublicense such rights to third parties at the discretion of the Organization/s.
The Speaker represents and warrants that all information in the Speaker Information is true and accurate, that all materials, slides, and handouts provided do not infringe upon any copyright, trademark, or other intellectual property right of any third party, and that any AI-generated or AI-enhanced content used in the Event has been reviewed, verified, and cleared by the Speaker, who accepts sole responsibility for its accuracy, originality, and legality. The Speaker further represents that they have full authority to enter into this Agreement and grant the rights described herein, and agrees to indemnify, defend, and hold harmless the Organization/s and their officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to the Speaker’s breach of this Agreement, including but not limited to intellectual property claims.
The Speaker acknowledges and agrees that no royalties or other compensation will be paid in connection with the rights granted herein, except for any honorarium or token of appreciation that may be agreed upon, if applicable. The Speaker hereby waives any right to claim royalties, residuals, or any other form of compensation related to the use, distribution, or commercialization of the Event, the Recordings, or the Speaker Information.
The Speaker may request withdrawal of this authorization by submitting a written request through the Organization/s’ designated contact form, but understands that such withdrawal will only apply to future uses of the Speaker Information and shall not affect any use, publication, distribution, or licensing made prior to the effective date of withdrawal.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. This Agreement constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes any prior agreements. By signing below, the Speaker acknowledges that they have read, understood, and agree to the terms of this Agreement.
